Please read these Terms carefully before using LiveHi. By downloading, installing, or using the LiveHi app, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and LiveHi ("we," "us," or "our") governing your access to and use of the LiveHi mobile application ("App") and related services (collectively, the "Service").
By accessing or using the Service, you affirm that:

You must be at least 13 years of age to use LiveHi. If you are under 13, you are not permitted to use the Service.
If you are between 13 and 17 years of age (or the age of majority in your jurisdiction, whichever is higher), you may only use the Service with the express consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
We reserve the right to require proof of age and to terminate accounts we believe belong to users under 13 years of age without notice.
The Service is intended for personal, non-commercial use. Commercial use of the Service requires a separate written agreement with LiveHi.
LiveHi uses Apple's "Sign in with Apple" for account authentication. By creating an account, you authorize LiveHi to receive a unique Apple User Identifier and optionally your name and email address from Apple.
You are responsible for:
We are not liable for any loss or damage arising from your failure to maintain account security.
You may only create one account per Apple ID. Creating multiple accounts to circumvent usage limits, free trials, or other restrictions is prohibited and may result in termination of all associated accounts.
You agree to provide accurate information when creating your account. You may use an Apple private relay email address; we do not require your real email.
Subject to your compliance with these Terms, LiveHi grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial purposes.

We may release updates to the App. You agree that these Terms apply to all updates, patches, and upgrades to the App, unless a separate agreement accompanies such updates.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You expressly agree NOT to use the Service:
You must comply with all applicable local, national, and international laws, regulations, and treaties in connection with your use of the Service, including laws governing privacy, data protection, export controls, and intellectual property.
Violations of this Acceptable Use Policy may result in immediate account suspension or termination without notice.
All in-app purchases are processed by Apple through the App Store using Apple's StoreKit payment system. LiveHi does not directly process payment card information. All purchases are subject to Apple's App Store Terms in addition to these Terms.
Prices for credits and subscriptions are displayed in the App in your local currency as determined by the App Store. Prices may vary by region and are subject to change. Tax (if applicable) is collected by Apple at the time of purchase.
If you purchase a subscription:
All purchases are final and non-refundable, except as required by applicable law or Apple's refund policies. To request a refund, contact Apple Support directly at reportaproblem.apple.com. We are unable to process refunds directly as all payments are managed by Apple.
We reserve the right to modify subscription prices. Price changes will be communicated through the App and/or via email. If you do not agree to a price change, you may cancel your subscription before it renews at the new price.
LiveHi uses a credit-based system where credits correspond to seconds of translation usage. Credits are deducted in real-time as you use the translation service.
Purchased credits do not expire, unless your account is terminated or suspended for violation of these Terms. Subscription credits reset at the beginning of each billing period and do not roll over unless otherwise stated.
The Service enforces concurrent usage limits. You may not use the Service through multiple simultaneous sessions in a way that exceeds your plan's permitted limits.
Credits have no cash value, are not transferable between accounts, and cannot be redeemed for cash or monetary equivalent, except where required by applicable law.
We may offer a free trial period for new users. The following terms apply to free trials:
The Service, including the App, website, API, software, design, text, graphics, logos, and all other content and materials, are owned by or licensed to LiveHi and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You are granted no right, title, or interest in or to the Service's intellectual property beyond the limited license described in Section 4.
You retain ownership of any content you create through using the Service. The real-time transcriptions produced during your translation sessions are considered your content. We do not claim ownership over content you create.
By using the Service, you grant LiveHi a limited license to process your voice audio solely to provide the real-time translation service. This license does not extend to storing, selling, or using your content for any other purpose.
If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant us a worldwide, royalty-free, perpetual, irrevocable license to use such Feedback for any purpose without compensation to you.
Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains how we collect, use, and protect your information when you use the Service.

We are not responsible for the availability, accuracy, content, or policies of third-party services. Links to third-party websites do not constitute endorsement by LiveHi.
Translation Accuracy: LiveHi relies on Soniox's AI-powered speech recognition and translation. While we strive for accuracy, translations may contain errors. Do not rely on LiveHi for critical communications where accuracy is essential, including but not limited to legal, medical, or safety-critical situations.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the maximum extent permitted by applicable law, LiveHi expressly disclaims all warranties, including but not limited to:
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIVEHI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.

Our total liability to you for any claims arising out of or related to these Terms or the Service shall not exceed the greater of: (a) the total amount you paid us for the Service in the 12 months preceding the claim, or (b) USD $10.00.
Some jurisdictions do not allow the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless LiveHi, its affiliates, contributors, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
You may stop using the Service at any time. You may delete your account by:
Account deletion is permanent and irreversible. Unused credits are forfeited upon account deletion. Refunds for unused credits are not provided unless required by applicable law.
You should also revoke LiveHi's access in your Apple ID settings: Settings → [Your Name] → Sign-in & Security → Apps & Websites using Apple ID.
We reserve the right to suspend or terminate your account, with or without notice, if:
Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination shall survive, including Sections 9, 12, 13, 14, and 16.
Before initiating any formal dispute, you agree to first contact us at support@livehi.net and attempt to resolve the dispute informally. We will try to resolve disputes within 30 days.
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law provisions.
You agree to submit to the exclusive personal jurisdiction of the courts located in Santa Clara County, California for the resolution of any disputes not subject to arbitration under these Terms.
To the extent permitted by law, you waive any right to participate in a class action lawsuit or class-wide arbitration against LiveHi.
If you are a consumer located in the EU/EEA, you may also have the right to submit a complaint to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
The following terms apply to your use of the App obtained from the Apple App Store, and are required by Apple:
You acknowledge that these Terms are concluded between you and LiveHi only, and not with Apple, Inc. ("Apple"). LiveHi, not Apple, is solely responsible for the App and its content.
The license granted to you for the App is limited to a non-transferable license to use the App on Apple-branded Products that you own or control, and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
LiveHi is solely responsible for providing maintenance and support services for the App. Apple has no obligation whatsoever to furnish maintenance and support services for the App.
In the event of App failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
LiveHi, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
In the event of any third-party claim that the App or your possession and use of it infringes that third party's intellectual property rights, LiveHi, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
Changes will not apply retroactively and will become effective no sooner than 14 days after being posted, except for changes addressing new features or required by law, which will be effective immediately.
